Subject of Grievance and Claim – Termination of Pension

Procedure Synopsis – After presenting the Court with the claim, and referral of the file to Branch 13, it was registered and completed; preliminary actions were taken, [illegible] timelines were determined, bills and presented documents were explained and observed, and, considering the advisory opinion of Mr. Mohammad Ebrahim Pishnamaz, ultimately on the above date as [illegible], the Court hereby concludes the hearing and issues a decision as follows.

Court Decision

In regard to the pending complaint as written in the claim presented, the subject of grievance and claim of the appellant, considering all the case documents and the appellant’s claim that her husband’s pension had been terminated owing to his belief in the Baha’i Faith, the appellee organization has also announced, through presenting the [illegible] Bill number 4/12/7008, 8 Esfand 1372 [27 February 1994], that termination of the pension of the heirs of the deceased Mohammad Afnani [illegible] regional organization [illegible] in Mazandaran Province was due to his association with the perverse Baha’i sect. Therefore [illegible] despite the fact that the appellant has not presented any documents or evidence in her complaint to prove her claim and [illegible] actions of [illegible] law, considering the [illegible] religious and legal rules and regulations, there is no justification to mandate government organizations to pay pension to the [adherents of the] perverse Baha’i sect, and there is no breach of rules and regulations in the actions of the appellee organization either. The complaint is deemed irrelevant and the ruling for the complaint is issued and announced. /A. B
