Procedural Synopsis: The Plaintiff’s Statement of Claim was lodged with the Court of Administrative Justice on 4 Mordad 1369 [26 July 1990], and has been registered and referred to this Branch and a second copy of the Statement of Claim and the enclosures were sent to the other party in these proceedings, who provided a response in letter No. 7/9149 -53 dated 6 Mehr 1369 [28 September 1990] and this is included in the file.

Following the conclusion of the legal procedures, a [hearing] was held at Branch 4 on 21 Mehr 1369 [13 October 1990] in the presence of the Presiding Judge and the Consultant, and having reviewed the contents of the file and taking into account the opinion of the Branch's Consultant, the court concluded its investigation and delivered its decision as follow:

Decision of the court: With respect to the claims of the retired and dismissed Captain Shemshad Ghaderi Saadi, son of Negahdar, against the Office of Army Insurance and Pensions, and his appeal against the termination of his retirement pensions, and given that the Insurance and Retirement Office of the Armed Forces in its letter No. 719149/53 dated 6 Aban 1369 [28 October 1990] in response to the claims of the above [Plaintiff], has stated that the retirement pension of the plaintiff was terminated in accordance with letter number 409/66/507/623 - dated 5 Shahrivar 1362 [27 August 1983] of the Office of the Prosecutor of Islamic Revolution for the Army because of his membership in the perverse Baha'i sect, this organization [Insurance and Retirement Office] accordingly has a duty to enforce [the regulations] and has no role in the termination of his retirement pension, and in view of Addendum 2 of Article 11 of the Court of Administrative Justice Act has specified that the decisions and opinions of Courts and other judicial authorities and military [courts] are subject to review at the Court of Administrative Justice and given there are no grounds for investigation, no comment will be made in relation to the complaint. This judgment is final.
