Subject of the appeal in relation to decision number 20 / H /111


Respectfully, I, Shafigheh Mohammadzadeh Arabi, Personnel Number [redacted], occupation teacher, dismissed from public service in accordance with decision number 20 / H /111, dated 22/6/1373 [13 September 1994], convey the following:  For the past 20 years I have served in this nation in the field of the education of children and [in doing so] have endeavoured with the utmost sincerity and uprightness to raise the scientific knowledge of this country’s children, as is reflected in my service records and personnel files.  I have devoted my youth and energy to this sacred goal and have striven to educate the children without mentioning any religious beliefs.  Therefore the issuance of such an order is not only far from Islamic justice and fairness but is also contrary to the principles of the Constitution of the Islamic Republic, as Article 19 declares: “The people of Iran enjoy equal rights, regardless of the tribe or ethnic group to which they belong.  Colour, race, language and other such considerations shall not be grounds for special privileges”, and Article 23, which forbids investigation into one’s beliefs and clearly states that no one can be subjected to questioning and aggression for merely holding an opinion.  Article 28 determines that: “People are free to choose whatever profession they wish as long as this profession is not in opposition to Islam, the public interest, and the rights of others.  In considering the needs of society for various occupations, the government is required to provide favourable circumstances for the equal employment of all persons”, and Article 14 thus decrees: “According to the honourable verse[1]: “Allah forbids you not, with regard to those who fight you not for (your) faith nor drive you out of your homes, from dealing kindly and justly with them. For Allah loveth those who are just” the government of the Islamic Republic of Iran and Muslims are required to treat non-Muslim individuals with good conduct, in fairness and [holding to the standards of] Islamic justice, and must respect their human rights. This principle is valid for those persons who have not conspired or acted against Islam and the Islamic Republic of Iran.”  Therefore, on the basis of the Articles cited above, the permanent dismissal from employment issued against me is in total contradiction with the provisions of the Constitution.  Moreover, the Baha’i Faith is not a sect but a divine religion, independent of all the other religions.  It believes in the truth of all the holy Manifestations, specially the prophethood of His Holiness Mohammad and the acceptance of the truth of the guardianship and Imamate of the 12 Imams, and it is the only religious minority in Iran which believes in the prophethood of His Holiness Mohammad and confirms the truth of the 12 Imams.  Therefore, it is far from Islamic justice and equity to consider such a believer as perverse and punishable under section 34 of Article 8 of the Employment Offences Act.  In consideration of the above-mentioned points, I beseech the Preliminary Commission for Investigation of Employment Offences to review decision 20 / H /111, and reverse the issued decision and deliver the required order for the continuation of my current employment.
