The Administrative Headquarters of the Command of the Imam, the Branch of Golestan Province
Peace be upon you:
Referring to letter N 180-2-1658, dated 28 Bahman 1377 [17 February 1999], in relation to the two pieces of urban and agricultural lands belonging to the condemned party, Mohammad-Ali Parsa, the following points are mentioned herewith to remove doubts:
1-What is understood as the temporary arable lands are those agricultural lands that have been possessed by the farmers since the triumph of the Islamic Revolution, until the end of 1359 , and their inclusion as urban lands; [the possibility that they will] have commercial value for residential purposes is quite remote.
2-Even supposing that the lands of this area become part of urban lands, this particular land will definitely not be considered as such, because according to the investigations carried by the [Board of] Land [Reform] the mentioned land has never had a farmer or an owner, and there is no indication that it has ever paid any rent; the Board of Land Reform could not interfere with lands that have no owners or farmers.
3-The government could not be considered as farmer or owner. To transfer a property to the name of the government requires laws and special regulations. Referring the government to the notary public offices is tantamount to disregarding the Law of Temporary Tilling. That is the reason that after the passage of eight years after the official report on discerning the temporary tilling, it has not been able to prepare an ownership document.
4-In the estimation of this court, the entirety of the land with main number 995 of 35 and the sub number 805 of 35,—the property belonging to Mohammad-Ali and Manuchehr Parsa, son of Mohammad-Vali—falls under Confiscation Order number 24754 [dated:] 30 Farvardin 1371 [19 April 1992] of the Fifth Branch of the Islamic Revolutionary Court of Tehran, according to section 9 of the Office of the Notary of Gonbad, and, due to its not being included in the Law of Temporary Tilling, it should be possessed by the Executive Headquarters under the directive of the Imam.%
