Complaint and Claim: To continue education, and request for a temporary order

 

Procedure:  The complainant has submitted a motion to the Court of Administrative Justice with the above-noted claim against the defendants.  Subsequent to the claim being registered under 35227 - 1 Mehr 1386 [23 September 2007] and given a case reference number (above), it was forwarded, along with a statement by the branch secretariat, for review and consideration by this branch.  At a special session, under the authority of the undersigned, Branch 4 of the Court of Administrative Justice reviewed the file.  Having considered the content of the claim made by the complainant and all related documents concerning the temporary order, the court reached a decision and rendered its decision as follows:

 

Ruling of the Court:

Subsequent to reviewing the content of the file regarding the claim made by the complainant, given that there is insufficient evidence to suggest that if the decision were carried out damage would be irreversible, the Court is not convinced that issuance of a temporary order is necessary.  Therefore, the above-mentioned claim does not meet the conditions set out in Article 15 of the new Court of Administrative Justice by-laws and its auxiliary directives.  As such, the Court rejects the claim and issues its decision to that effect.  As for the main complaint, a decision will be rendered in due course after a proper hearing is held.
