The Significant Four-Article Directive of the Revolutionary Public Prosecutor General to the Prosecutors’ Offices and Courts,

From the public prosecutor general of the Islamic Republic of Iran, a directive has been issued to all   Prosecutors’ Offices of Iran and all prosecutors’ offices of the Islamic Revolution situated within the Revolutionary Guards.

The content of the directive is as follows:

To carry out the important orders of the imam of the nation, the leader of the Islamic Revolution of Iran, the attention of all the public prosecutors, assistant prosecutors and magistrates of the prosecutors’ offices, plus the public prosecutors of the Islamic Revolution situated within the Revolutionary Guards, and respective representatives from across the country, is hereby drawn to these points:

1- The issuance of an arrest warrant, detention, and arresting people, without thorough investigation and observation of sufficient documents, should strictly be stopped. In cases of the existence of sufficient proofs and documents for the accused—except for the fighting groups or individuals whose freedom could be warranted by paying bail or depositing security—as much as possible, arrest and imprisonment should be avoided.

2- Under no circumstances do the revolutionary guards and the committees have the right to summon, apprehend, detain, inspect the house and impound the possessions without obtaining legal warrants from the judiciary authorities. In such cases, it is the duty of the local revolutionary prosecutors’ offices to legally prosecute them.

3- Individuals who are not revolutionary guards and arbitrarily take actions for arrest, apprehension and impounding people’s possessions, will be harshly prosecuted.

4- It is essential that, prior to taking any action to [seize] the individuals’ moveable and immovable assets or freezing their bank accounts, all the necessary documents and proofs be gathered and investigated, so that irregular impounding of people’s assets and freezing their bank accounts is avoided. It is imperative that swift investigation and actions be taken to stop sending the records to the prosecuting office or removing the arrest orders. Return or confiscation of the properties are [dependent on] the issuance of an order by the Sharia judge and its approval by the Supreme Court. Otherwise, it will lack legal credibility.

This announcement through media constitutes official notice, and violators of this circular will be prosecuted by the Revolutionary Prosecutor’s Office.
