Procedural synopsis: The plaintiff’s claim, following its registration under number 8570 of 16 Ordibehesht 1386 [6 May 2007] with the Court of Administrative Justice and referral of the Second Branch, as referenced above in this Branch, and after carrying out the initial procedures, has been examined in an extraordinary session under the supervision of the undersigned. Subsequent to a review of the case and receipt of the response of the defendant, the hearing was concluded and the following decision rendered.

 

Decision of the Court:

With regard to the appeal of Mr. Bashir Dana, and the defendant parties, being the Ministry of Science, Research & Technology and the University of Payame-Nour, appealing for the acceptance of the university admission test of year 1385 [2006], and the continuation of education, considering the contents of the file and responses received, since the claimant’s situation is in accordance with the decree of the Supreme Council of Cultural Revolution, and there being no legitimate objection which would prove the violation of the regulation to validate the request, the plaintiff has no right to claim and the claim is rejected. This decision, according to Article 7 of the Court of Administrative Justice, is final and binding. /Z
