The twenty-seventh session of the Dispute Settlement Committee of Shiraz was held at 5:30 p.m. on Tuesday, 3 Shahrivar 1360 [25 August 1981] to investigate the complaints of Mr. Yadollah Shams and Mr. Khan Baba Golshan, employees of the Department of Islamic Guidance.          

 

1- Mr. Yadollah Shams, 63 years old, married with three children and record service of 10 years, 5     months and 27 days, has received wages of 940 rials;

2- Mr. Baba Khan Golshan, 67 years old, married with three children and record service of 10 years, 6 months and 26 days, received wages of 940 rials.

 

Subject of dispute: Dismissal

According to invitation letter number 8023, of 26 Mordad 1360 [17 August 1981], both parties were invited. The employees that were present in the meeting said, “Our statements are according to the minutes of the workshop council.” Mr. Abdol-Karim Mehraban Jahromi, representative of the employer, was present and said, “My statement is according to the minutes of the workshop council; the employees were dismissed due to having corrupt beliefs, and are Baha’is.” The minutes of the workshop council and circular number 2715, of 20 Ordibehesht 1360 [10 May 1981], from the deputy supervisor of work relations, were read. The Dispute Settlement Committee, considering the content of the file and letter number 2715, of 20 Ordibehesht 1360 [10 May 1981] from the deputy supervisor of work relations, issues the order stated below:

1- Mr. Yadollah Shams, Ali Akhoundi-Anar

A: For the remuneration of the entitled leave [days] that were not taken, [an amount] equal to 22,560 rials.

B: For compensation of the articles above and under Article 33 of the Labour Act, [an amount] equal to 197,340 rials. Therefore, the total claim of Mr. Yadollah Shams Ali Akhoundi-Anar will be equal to 219,900 rials.     

2- Mr. Baba Khan Golshan

A: For the remuneration of the entitled leave [days] that were not taken, [an amount] equal to 15,980 rials.

B: For compensation according to the articles above and under Article 33 of the Labour Act, [an amount] equal to 198,967 rials. Therefore, the total claim of Mr. Baba Khan Golshan will be equal to 214,947 rials. The employer (Department of Islamic Guidance of Fars - G [letter]) has the option of either paying the total amounts to those above-mentioned individuals or, after paying their wages for the uncertainty period, employing them again.

The employer is also obliged to calculate and pay the wages of the period from 11 Azar 1359 [2 December 1980] to 14 Mordad 1360 [5 August 1981]—which were paid partially—in full and equal to the amount of their previous month’s wages. Should there be any difference between these two payments, adjustments must be made for paying the difference.  This issued order is final and enforceable.
