In the Name of God,

To the Esteemed Public Prosecutor,

With greetings, I present this information in relation to the issues that appear below. As Ms Misaghi has attended the Supervisory Unit on numerous occasions, it is hoped that by providing a final response, steps will have been taken to prevent her from revisiting this Prosecutor’s Office.

The assets of the father of the aforementioned person (Amanollah Misaghi) were seized by the Islamic Revolutionary Court of Ahvaz and this involved the aforementioned person because she owned a property located in [redacted].  The Prosecutor’s Office delegated the matter to the Supervisory Unit [along with the management rights] and as soon as the writ for execution was received, the Supervisory Unit handed over the property, which was occupied by 2 tenants at the time, to The Department of Finance. However, we have recently realised that Mrs. Misaghi was living beside the tenant on the first floor, which from our point of view means that she was neither a tenant nor was her claim for occupation [of the property] lawful. Therefore an eviction order was issued and the building was vacated by the tenants. Unfortunately, she [Mrs. Misaghi] considers herself the property owner and is still in the house. A representative of the Finance Department has given her until 22/8/69 [13 November 1990] to vacate. In any case, the Supervisory Unit’s view is that the Ahvaz Prosecutor’s Office must provide her with a [final] response and reinforce that her occupation [of the building] is unlawful.

As this Prosecutor’s Office has had no role in examining [this case] or issuing the order but has acted merely as a delegate in executing the writ, the Prosecutor’s Office as you have stated, is unable to make a decision on your details of this case. If she attends [your office] again, advise her to refer the issue to Ahvaz Prosecutor’s Office.
