First Committee for the Investigation of Human Resources Complaints of Official Government Employees
In reference to letter number 2607 – 8 Ordibehesht 1350 [28 April 1971], enclosed with the second draft of the complaint of Mr. Mohammad Etemadi Esfahani – 4739T – the following is conveyed.
According to Article, 2 Para 4 of the National Employment Act, ratified 1301 , and Article 14 Para [illegible] of the new National Employment Act, official government employees [illegible] and teaching staff, in particular, should have special qualifications, including “no records of corrupt beliefs, bad reputation of immorality or known debauchery”. In addition, Article 8 of the said Act states, “Expression of political views in administrative matters and propaganda against the official religion of the country or against the national government is absolutely forbidden and will be cause for dismissal,” and those who enter into government service must adhere to the officially recognized religions of the state. In a [illegible] from the prime minister, issued under number 7682 – 24 Tir 1334 [16 July 1955], it has been explicitly noted that “Employees who engage in public debauchery or are openly following religions that have not been recognized in the Constitution must be dismissed from service. At this time, employees who insist on admitting to being Baha’is should be dismissed from service”. Likewise, since the foundation of the education of the children of the nation is established at the elementary level, and teachers in these grades are expected to cover all subjects, including religious education and the Quran, in consideration of the above-mentioned legal standards and the prime minister’s instructions, issued with due attention to these matters, the continuation of service of the complainant, who has repeatedly insisted on his adherence to the Baha’i faith, is not in the interest of the field of education. As such, a writ of dismissal from service will be issued for him for lack of qualification pursuant to Article 2 of the National Employment Act, ratified in 1301 , under number 12429 – 3, 22 Khordad 1345 [12 June 1966]. Consequently, with due attention to the above-mentioned matters, a request is made for investigation and issuing of the appropriate judgment.
