Honourable President of the Court of Administrative Social Justice
Subject: Pleading for Justice Regarding the “Incomplete File” for Mahta Mokari in the 1393  National University Entrance Examination.
Hereby I respectfully submit the following:
I have a high school diploma in mathematics and physics, and I participated in this year national university entrance examination along with my other friends. However, on the relevant website, I received a “Incomplete File” result for my case. Given that it is not possible to meet with you in person under any circumstances, I would like to share my problems with you through this letter.
As you know, the third principle of the Iranian constitution obliges the Iranian government to provide free education and physical training and higher education for all at all levels. The right to education for all human beings without any discrimination is explicitly guaranteed in international treaties, including those signed by Iran. These treaties include the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, and the UNESCO Convention on the Elimination of All Forms of Discrimination against Education. The treaties are enshrined in the Iranian Constitution, which supports rallies, and prohibits discrimination against individuals on the grounds of life, race, sex, religion, creed, or political or other beliefs. Citing Mr. Hassan Rouhani, who has repeatedly promised in his election campaign to respect human rights, and the rights of the nation, he explicitly stated, “All Iranians must receive justice. Justice means equal opportunity for all ethnic groups of all religions even religious minorities”.
Another principle included in paragraph 14 of the Article 3, and Articles 19 and 20 of the Constitution, in which the right to equality and impartiality is emphasized, implies that all Iranians are equal before the law. Also, in Article 14 of the Constitution, the observance of human rights for all Iranians, regardless of their beliefs, has been emphasized and stressed. Despite the above principles and the equality of all Iranians before the law, unfortunately, a circular was issued by the Supreme Cultural Council in 1369  regarding the status of Baha’is in Iran. The circular was contrary to the above principles and highly discriminatory. Given that a circular cannot and should not be against the law, including the constitution, this issue should be considered, and the government authorities should resolve this obvious and aggressive contradiction.
In addition, General Theory 13 of the International Covenant on Economic, Social and Cultural Rights states that the deprivation of students and teachers of scientific liberty is a violation of Article 13 of the Covenant which states that scientific liberty is possible only in an environment where higher education and academic freedom are independent. The definition of scientific freedom is taken as follows: “Without imposing ideological restrictions on the freedom of teaching and debate, freedom to conduct research and disseminate and spread its results, freedom of expression, freedom from censorship and freedom to participate in specialized institutions and elections without any discrimination or fear of repression by the government or other authorities.”
Given the above, it is clear that one of the main duties of government authorities is to adhere to the constitution and to implement international treaties and protect all human rights of the society.
I was born to Iranian parents and therefore I am an Iranian citizen and fully aware of the mutual rights and duties of the government and the people. Thus, I demand my due rights. The right to education and the right to growth and development, and with the goal to excel is one of the most valuable human rights. [Permit me to] quote the words of Imam Ali who said, “Never say that I am only an agent and excused, never say that I have been ordered and I must obey blindly, and also never be greedy to be obeyed blindly…”
I request you, the respected authority, to please issue the necessary instructions so that I can also attend university and benefit from a higher education. I hope that your orders will be a way for me to be as effective as possible as a citizen in this country.
(I would like to inform you that I have also sent my request to the Evaluation Organization of the Ministry of Science and the Article 90 Commission, and I will attach a copy of the receipt for this letter.)
