Ayatollah Mahdavi Kani, esteemed head of the Central Committee

Further to [our] letter of Farvardin 1358 [March/April 1979] regarding the invasion, possession and destruction of properties owned by this company, which has happened in different parts of the country―and the case was communicated to you in person and in detail―we trouble you again to convey that on 16 Khordad 1358 [6 June 1979] the agents of the Mostazafan Foundation [foundation for the poor], based on an order they presented from the Foundation, intended to occupy and possess Misaghieh Hospital (the property of which belongs to this company). In that [order], it was written that Misaghieh Hospital and Omana Company should be under the control of the representatives of the Mostazafan Foundation.

On the morning of 18 Khordad 1358 [8 June 1979], I went, together with the lawyer of the company, to the office of the revolutionary public prosecutor general and inquired about the order which had been issued in this regard. It turned out that no order had been issued by the esteemed revolutionary public prosecutor general, and they said that an order may have been issued by the public prosecutor of Tehran. We then went to the Mostazafan Foundation. They also refused to show the order. However, on 23 Khordad 1358 [13 June 1979] a few individuals, who identified themselves as agents of the Mostazafan Foundation, again without presenting a court order, came to the office of this company, released all the employees and seized the books, documents and papers in the company which had survived the repeated rapines in the past, and they are now settled in the company and the documents are in their hands.

This action of the agents is not in compliance with any Sharia or legal standards, because, according to the fatwa[1] of Grand Ayatollah Khomeini, which was published by the government spokesperson and through the mass media, confiscation of property and assets of individuals, both real and legal, is contrary to Islamic law. Other esteemed ayatollahs have confirmed this matter, as well, and since the government has also stated that it has not taken any action to confiscate the property, we ask that esteemed official to issue instructions to have individuals who have interfered with the affairs of this company and intend to seize and possess properties which both have historical significance and are needed by the Bahá’ís as places of worship and gatherings, as well as cemeteries in the cities of Iran, to stop their disturbances, so that these properties in Tehran, other cities and villages are safeguarded against any aggression and that, God forbid, no problems will come up due to ignorant instigations and prejudices.
