Procedure synopsis: On 29 Azar 1394 [20 December 2015], the extraordinary session of the meeting of Branch 1 of the Governmental Discretionary Punishments Office in Khomein, presided over by the undersigned, is convened to review the above-mentioned case. The case documents indicate that the inspectors of Arak University of Medical Sciences have referred the company in question to this Branch, with regard to the violation of the establishment of a medical institution by a specialist without a work permit, for review and an appropriate decision. Subsequent to reviewing the case, the Branch concluded the hearing, and, with the assistance of the Almighty God, rendered its decision as follows.

Branch Decision

Regarding the accusation of the establishment of a medical institution by a specialist without a work permit, attributed to Mr. Laghaollah Baghaie with the above-mentioned details, in light of the file records and report number 49837S/2/93/P, dated 18 Aban 1394 [9 November 2015] of the Commission for Article 11 of Arak University of Medical Sciences, it is clear and evident in the papers and documents of the case file that the aforementioned person must obtain an Business licence and does not have the right to work in the field of manufacturing and selling optical glasses without a licence. Therefore, by invoking the first degree of Article 2 of the Law on Governmental Discretionary Punishments in Health and Medical Affairs, approved by the respected Expediency Council on 23 Esfand 1393 [14 March 2015], the closure of the mentioned person’s institute is ordered and announced. The judgment is not final and issued in person, and in the implementation of the provisions of Article 24 of the By-Laws of the Organization, this court order may be appealed within 10 days of its issuance at the Provincial Court of Appeals. After the implementation of the final ruling of Addendum 2 of Article 16 of the Court of Administrative Justice Code of Procedure, it can be challenged in the Court of Administrative Justice within the prescribed time limit. The office is required to act in accordance with the regulations.
