On 14 Aban 1373 [5 November 1994] during an extraordinary session, a Special Court was convened to consider the files related to the order issued on 16 Shahrivar 1368 [7 September 1989] and Article 49 of the Constitution, with the undersigned presiding, to carry out the order contained in case reference 62/M/33719, regarding Mr. Faramarz Iraninejad, in relation to the judgement number 25524, dated 22 Tir 1371 [13 July 1992].
After hearing the statement of Mr. Moslem Rashidayee, representative of the Bonyad-e Shahid [Martyr Foundation] of the Islamic Revolution, and that of Mr. Faramarz Iraninezhad, and reviewing all contents of the file, with reliance on the discretion given to it by the National Order dated 16 Shahrivar 1368 [7 September 1989], the Court proceeds to issue its decision as follows. %
Decision of the Court: Regarding Mr. Faramarz Iraninejad, in view of the contents of Judgement number 25524, dated 22 Tir 1371 [13 July 1992], according to which he has been sentenced to pay the sum of fifty million tomans (five hundred million rials) to the Division in Charge of Enforcing the Order of the Imam [Khomeini] ( may the paradise of exalted God be upon him), given that the period allowed for the payment of the amount contained in the sentence has expired and the aforementioned individual has not paid the money, the sentence of the aforementioned individual will be carried out―given that assets of Mr. Faramarz Iraninejad are under supervision of the Bonyad-e Shahid of the Islamic Revolution―and the Division in Charge [of Enforcing the Order of Imam Khomeini], according to the rule of custody, will seize the right from the aforementioned individual to have any supervision over the assets now under the supervision of this esteemed [Bonyad-e Shahid] Foundation.
However, regarding the assets of Bahram Iraninejad, resident of the United States of America, Daryoush Iraninejad, resident of Germany, and Mehrangiz Iraninejad, resident of the United States of America, based on the contents of the case file and the documents recorded in the files that establish their membership in the perverse Baha’i sect, and their exit from the territory of the regime of the Islamic Republic of Iran, and the fact that their assets are under the supervision of the Bonyad-e Shahid of the Islamic Revolution, with reliance upon the order dated 17 Mehr 1370 [9 October 1991], this Court approves the confiscation of the above-mentioned assets for the benefit of the aforementioned Bonyad.
This decision is in accordance with religious principles, and it is final and binding. The executive office must carry out this order. A copy of this order is to be sent to the Bonyad-e Shahid of the Islamic Revolution for follow-up. % 13
