Complainant’s appeal: Restitution of Employment

3. Not only is the issued order against the Employment Laws and Regulations of the country, it is also discordant with and contradicts Articles 22 and 23 of the Constitution of the Islamic Republic of Iran, as well as the Declaration of Human Rights and other international agreements which have been ratified by the Iranian government.

4. According to Principle 14 of the Constitution of the Islamic Republic of Iran, and the instructions of one of the verses of the Holy Quran, the government of the Islamic Republic of Iran and all the Muslims are duty-bound to treat non-Muslims in conformity with ethical norms, equity and justice and respecting their human rights.

 With regard to the mentioned matters, during all the years of my service, I have not committed the slightest displeasure and annoyance at work. I have been in the service of the nation and the compatriots in utmost truthfulness and honesty. With regard to the [fact] that the issued order is contradictory to Articles 14, 59 and 124 of the Employment Act of the country, approved 45 and Article 6 of the Employment Regulations Act of the Social Security [Organization], and Principles 22 and 23 of the law issued by the Islamic Republic of Iran, it is requested [that you] recall judgment [rescind the issued order] and allow me to return to my service, arranging for the days I have [lost]. 

 Council Meeting - The meeting of the Council to investigate the complaints of the permanent employees of the Social Security Organization was called at 8:30 [a.m.], Tuesday, 31 Farvardin 1361 [20 April 1982] at the office of Hasan Afshar Sadiq and with the participation of the signatories mentioned below. The Council, after consultation and having considered the background of the matter, has decided the following:

The Decision of the Council:

As paragraphs 6 and 14 of the National Employment Act and the Employment Regulations Act of the Social Security Organization indicate, one of the sound conditions of employment is that the employee must not have corrupt ideologies. Since the authorities competent to recognize “corruption of belief” are the religious leaders of the country’s official religion, and the esteemed religious authorities, in many juristic opinions, have considered the perverse Baha’i sect as a deviant sect and obvious contradiction to the true religion of Islam and the Faith of the Seal of the Prophets, the complaint of the plaintiff is baseless and her working agreement is invalid, and the Dismissal Board considers her dismissal to be rightful and lawful and approves it.

According to Article 37 of the Employment Regulations Act, the implementation of this judgment by the organization is mandatory. Appealing is possible for the complainant in any public court of justice of Tehran, only within ten days of having seen the final decision. /1
