Procedural synopsis: Subsequent to the registration of the complainant’s application under 8570-16 Ordibehesht 1386 [6 May 2007] by the Court of Administrative Justice and assignment of the case to Branch 2, where it was registered under the above-mentioned case reference number, and after completing preliminary administrative protocol, the court reviewed the case file, including the statement of the respondent, at a specially designated time and in the presence of the undersigned. The court then concluded the proceedings and rendered the following decision:
Court Verdict
With respect to the application of Mr. Bashir Dana against the Ministry of Science, Research and Technology, and Payame Noor University, concerning [his] passing the National Entrance Examination of 1385 [2006/2007] and continuing [his] education, this court has considered the content of the file and the statement of the respondent and reviewed the situation of the above-named person in light of current law issued by the Supreme Council of Cultural Revolution, based on which he was refused entry, and finds that the plaintiff’s case has no legal merit and does not constitute deviation from the policies. As such, there is no evidence of any offence having been committed to merit a favourable ruling for the plaintiff. The plaintiff has therefore failed to establish his claim and his complaint is thus dismissed. This decision, in accordance with Article 7 of the Tribunals Act, is final.
