Preliminary Commission for the Investigation of Employment Offences of the Central Administration

The meeting of the Preliminary Commission for the Investigation of Employment Offense of the Central Administration as held at section one on 4 Dey 1364 [25 December 1985], with the presence of one principal member and two alternate members, to investigate the allegations against Mr. Azizollah Rowhani, son of Abdollah, birth certificate number [redacted], issued in Kashan, born [redacted], employment number ---, last academic certificate [high school diploma], in group 5, level 7 and the last position--- covered by the pension of the Department of Education of the city/county/region of Administrative section as follows:
Procedural Synopsis: The file of the mentioned person, who is accused of membership in the perverse Baha’i sect, [came] under investigation by the Preliminary Commission for the Restructuring of Human Resources of the Ministry on 28 Ordibehesht 1362 [18 May1983]. [In reference] to Article 40 of the Restructuring of Human Resources Act, [he] was sent to the Office of the Islamic Revolutionary Prosecutor of the Centre for investigation. However, owing to a lack of response from the responsible authorities, as a result of the termination of the allocated time of the mentioned commissions, and lack of investigation or response from the competent authority, the decision was not taken; therefore, the continuation of the investigation, enforcing Article 23 of the [Preliminary] Commission for Investigation of Employment Offences Act, was referred to this Commission.
The Commission, in enforcing Article 17 of the above-mentioned Act, in letter number 1079/BM, dated 29 Mordad 1363 [20 August 1984], following the communication of the Preliminary Commission for the Restructuring of Human Resources of the Central Administration of the Ministry, requested the result of the investigations from the court. After repeated correspondence, the Office of the Islamic Revolutionary Prosecutor, on the date of 4 Dey 1364 [25 December 1985], letter number 31299/2/62, enclosed with the photocopy of the judgement of Branch 6 of the Islamic Revolutionary Court of Justice of Tehran, was sent to this Commission, [indicating] that the decision of the Court was exactly as mentioned below:
(In considering the totality of the contents of the file and the statement of Mr. Azizollah Rowhani, son of Abdollah, the guilt of the accused in relation to membership in the perverse Baha’i sect and illegal employment is evident to the Court. Therefore, it is necessary that the mentioned [person] be dealt with according to the regulations.)
The Commission, after reading the contents of the file and considering decision number 4821 of the Islamic Revolutionary Court of Tehran, rendered the following decision:
Decision of the Commission: Considering the stated explanation in the procedural synopsis and the contents of the decision of the Islamic Revolutionary Court, the offence is evident and corresponds to Article 17 of the Investigation of Employment Offences Act; therefore, the Commission unanimously, according to the same Article, sentences the mentioned [individual] to permanent dismissal from government service, and concludes that the employment of the mentioned person has been illegal since the beginning and all salaries and benefits paid to him are revocable.
